Protecting Your Interests When Your BAC Exceeds .15 Percent
Arizona DUI law provides for different DUI penalty schemes, and the one that will apply in your case will depend on your blood alcohol concentration (BAC) as measured by a breath, blood or urine test. For people over 21, you can be charged with "DUI per se" if your BAC was over .08 percent. If your BAC was allegedly between .15 and .20 percent, you can be charged with "extreme DUI" with significantly heavier consequences than DUI per se.
Our Phoenix Extreme DUI Defense attorney also represent people charged with "super extreme DUI". You can be charged with super extreme DUI if your BAC is found to be at .20 or higher. Finding the Right Defense Based on the Facts of Your Case
Our attorneys take three basic approaches to the defense of extreme DUI charges. First, we review the full circumstances of your traffic stop and arrest to see whether we can prevent the prosecution from going forward with the case. Next, we work with forensic experts to see whether the BAC evidence can be challenged, if not to defeat the evidence of intoxication then at least to bring it under .15 percent. Finally, once our investigation is complete, we can go to work with the prosecution to achieve an acceptable compromise plea on significantly reduced charges whenever possible.
Although we can present your defense at trial, we can usually avoid the risk of an adverse verdict by working out an arrangement with the prosecution. We're frequently able to protect our clients from the severe penalties that can result from an extreme DUI conviction — a minimum of 30 days in jail, a 90-day license suspension, alcohol screening and treatment. If you have a prior conviction, the minimum extreme DUI penalties are substantially tougher.
